   Tax Abatement Guidelines

 
OBJECTIVES

Primary Job Creation - Target Industries

Amount Abated - Minimum to be competitive

Fair to Jurisdictions - It is a local option

Fair to Existing Business - Modernization, Expansion

Regional Cooperation - Similar Abatements

Flexibility - Strictly Enforced Variance Procedure.

 
TERMS

Abatement shall not Exceed Five (5) Years Including Construction Time.
   100% 1st Year
   100% 2nd Year
    75%  3rd Year
    60%  4th Year
    50%  5th Year

 
FACILITIES
THAT
QUALIFY
Manufacturing, Regions Service and Distribution, Regional Entertainment, Research and Development and Other Basic Industry.
 
AUTHORIZED
INVESTMENTS
New Plant, Expansion, and Modernization.
ABATED Buildings and structure, fixed machinery and equipment, site improvements, office space to administer plant
NOT ABATED Land, existing improvements, construction-in-progress, personal property, Hotels, housing, pipelines, gas and fluid storage, electrical generating facilities, deferred maintenance, property with a useful life less than 15 years.
ECONOMIC Minimum $500,000 investment, retain or create at least 5 jobs, cannot reasonably use existing property.  No "serious adverse effect" on jurisdictions.
SPECIAL CONDITIONS In addition to agreeing to create five (5) new jobs, the Owner agrees to "exercise its best efforts to insure" that . . . 
  • Fifty percent (50%) of total new employees are residents of Chambers, Harris or Liberty Counties.
  • A minimum of two (2) new employees are residents of Chambers County, and 
  • Five percent (5%) of the new employees, or a minimum of one (1) , are residents of the city in which the facility is located.
  • Companies receiving tax abatements agree to pay an economic development fee as follows:
    1. Pay fee of one half of one percent (1/2 of 1%) of the final construction appraised value per year for three (3) years for projects valued at $300,000 or greater, maximum fee not to exceed $10,000 per year.
    2. Projects located east of Cedar Bayou, south of Interstate 10 and west of Trinity River and Trinity Bay shall make fees payable to the Baytown West Chambers County Economic Development Foundation.
    3. Projects located outside the area designated in item 2 above shall make fees payable to the Chambers County Economic Development Fund.
